Good morning, thank you for passing on the concerns of the resident, the next planned works are due on the 12/25,
In relation to the sap, under the Highways Act 1980, the Local Authority has a duty under Section 41 to maintain the highway in a condition that is safe for ordinary traffic to pass and repass. This duty, however, does not extend to guaranteeing that the highway is always free from temporary hazards such as leaves, berries, or fruit, which may fall naturally from trees. These occurrences are recognised as part of the natural environment and are minor, short-term hazards that cannot reasonably be prevented. The Local Authority also has obligations under the Occupiers? Liability Act 1957 and 1984, which are met by ensuring that a reasonable system of inspection and maintenance is in place.

The tree hasnt been trimmed for a very long time and has grown significantly. It also releases a wax-like substance that damages our front garden. Im also concerned about potential safety issues, as the roots have become quite large and could pose a risk if not maintained properly.
